1. Request for Mediation Fill a form and submit to request for mediation, you can also reach out via email or phone to inquire about the mediation process, availability and fees. Be prepared to provide a brief description of the dispute, parties involved and any relevant time constraints.
2. Case Evaluation Once the request is made, TMB acknowledges the request and reviews the request to ensure that mediation is appropriate for the nature of dispute. Extra information may be requested at this stage.
3. Attend Preparatory Meeting Parties would be required to attend an initial meeting where they will be briefed on the proceedings, assuming that both parties have consented to mediate. To enable parties to make well-informed decisions, discussions will be held regarding the location, method, requirements, and the goals. Parties will pay applicable fees within a given timeframe and sign an agreement to mediate after the meeting if they agree to proceed.
4. Select Mediators Disputing parties are assisted in selecting from a pool of mediators based on the nature of the dispute and their area of expertise.
5. Schedule an Appointment Parties are encouraged to choose the days and times for the mediation sessions based on the significance and urgency of the matter at hand, even though the procedure is flexible and results in little time lost.
6. Mediation Day(s) All involved parties will meet with the mediator to begin the resolution process. The mediator will facilitate a structured discussion, guiding parties through the process of identifying issues, exploring possible solutions, and negotiating a mutually agreeable settlement.
7. Follow – up TMB collects feedback and insights from clients and partners after each session and on their experiences with the hub. We then assess what worked and what didn’t and make adjustments accordingly.
